- Disclaimer of Warranty.
Software obtained free of charge, whether in source
or in binary forms, are provided on an "AS IS" basis, without
warranty of any kind, including without limitation the warranties
of merchantability, fitness for a particular purpose and non-infringement.
The entire risk as to the quality and performance of the Software is born to you.
Should the software prove defective, you and not Hyfly assume the entire
cost of any service and repair you may desire. In addition, the security
mechanisms implemented by Hyfly software have inherent limitations,
and you must determine that the Software sufficiently meets
your requirements.
- Limitation of Liability.
As customary in the computer business, WE HAVE TO STATE
EXPLICITLY THAT IN NO EVENT SHALL HYFLY BE LIABLE
FOR ANY LOSS OF PROFIT OR ANY OTHER COMMERCIAL DAMAGE, INCLUDING BUT NOT
LIMITED TO SPECIAL, INCIDENTAL, CONSEQUENTIAL OR OTHER DAMAGES. MODULAWARE
SPECIFICALLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESSED
OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF
MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, RELATED TO DEFECTS IN
THE SOFTWARE OR DOCUMENTATION.
